Majesty The Sultan and Yang Di-Pertuan of Brunei Darussalam today announced
that the enforcement of phase one of the Syariah Penal Code Order in Brunei
will commence with effect from tomorrow, May 1, 2014.
The
first phase of the Order covers general offences set by the state, including
disrespecting the month of Ramadhan and not performing Friday prayers. General
offences are punishable by fines, imprisonment or both.
Corporal
punishment such as whipping and amputation of limbs for crimes such as theft
will not be enforced until the second phase. The death penalty will come into
force in the third phase.
Brunei
tidak mengharapkan negara lain bersetuju atau menerima pelaksanaan hukum hudud,
namun memadai dengan menghormati keputusan negara ini sebagaimana Brunei
menghormati pihak luar.
Negara
yang mempunyai rakyat beragama Islam seramai 70 % daripada jumlah pendu-duknya
telah pun melaksanakan hukum hudud. Perkara tersebut telah pun diumumkan oleh
Sultan Brunei, Sultan Hassanal Bolkiah dalam majlis Deklarasi Perintah Kanun
Kesek-saan Jenayah Syariah 2013 Fasa Satu di Pusat Konvensyen Antarabangsa.
Perundangan
syariah tersebut bakal dilaksanakan secara berperingkat-peringkat selama 3
tahun, bermula dengan
kesalahan-kesalahan ta’zir (seperti kesalahan khalwat dan perbuatan tidak
sopan)
Sebelum
ini, perlaksanaan ini telah ditangguhkan akibat menerima kecaman Majlis Hak
Asasi Manusia PBB atas alasan “sangat bimbang” dan mendakwa, hukuman seperti
mere-jam dengan batu diklasifikasi undang-undang antarabangsa sebagai hukuman
“penderaan kejam dan tidak berperikemanusiaan.”
Tidak
mengubah pendirian walaupun menerima kecaman sebegitu, Sultan Hasanal tetap dan
tegas dengan pendirian tersebut.
